Terms and Conditions of Sale

This purchase is governed by the terms and conditions below, which are based on the standard terms provided by the Norwegian Consumer Authority (Forbrukertilsynet.no). These are standard terms and conditions for the purchase of goods online. They are intended to ensure that e-commerce complies with applicable consumer protection legislation, including the Norwegian Consumer Purchases Act [1], the Right of Withdrawal Act [2], and the E-Commerce Act [3].

The Norwegian Consumer Purchases Act applies to the sale of goods by a business to a consumer who is not acting as part of a business activity.

1. The Agreement

The agreement is primarily made up of the information provided to the buyer during the ordering process (such as the type and quantity of goods, price, delivery terms and other characteristics), any direct communication between the parties (in writing by email or SMS, or verbally by telephone), and these standard terms and conditions.

These standard terms and conditions may be deviated from in favour of the consumer if this is agreed through direct communication between the buyer and the seller (in writing by email or SMS, or verbally by telephone).

Specific information requirements relating to the goods and any options offered by the seller, such as delivery options, are provided during the ordering process.

2. The Parties

Buyer:

The consumer placing the order, also referred to as "you" or "the customer".

3. Prices

All prices are displayed in Norwegian kroner (NOK). Product prices are displayed excluding shipping and payment fees. Any shipping and payment fees will be shown before the order is placed.

We reserve the right to change product prices. The price stated in the order confirmation is the applicable price under the agreement between the parties.

We reserve the right to cancel orders if an incorrect price has been displayed and the buyer should reasonably have understood that the price was incorrect at the time of purchase. This also applies after an order confirmation has been sent. If this occurs, the buyer will be notified by email.

Promotions

Promotions may be offered as a discount on the regular price of a product for a limited period. Discounts cannot be applied retroactively to orders that have already been placed.

At present, delivery is only available within Norway. If you would like an order to be shipped outside Norway, please contact us at moscreateda@gmail.com.

4. Conclusion of the Agreement

The agreement is binding on both parties once the buyer's order has been received by the seller.

We reserve the right to cancel orders due to products being out of stock as a result of incorrect inventory information. The seller is required to inform the buyer of any cancellation due to incorrect stock levels as soon as the error is discovered.

If this results in part of the buyer's order being cancelled, the buyer will be informed accordingly. The buyer will not be charged for cancelled items.

5. Payment

MOS Create DA offers the following payment methods:

Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden.

Through Klarna, you can pay by card, invoice or Klarna account.

Card

Payments are processed by Klarna, a secure electronic payment provider for Visa and Mastercard.

With Klarna, you have the same guarantees and security as when shopping in a physical store. The payment pages are secured using SSL, and all card details are encrypted. This means that no one can read your credit card number, name or address while the information is being transmitted over the Internet.

Invoice

The payment due date is 30 days from the date the goods are shipped.

You can find the invoice terms. Please note that you will receive the invoice by email, so it is very important that you enter the correct email address.

We recommend checking your inbox after completing your purchase to make sure you have received your order confirmation. If you have received the order confirmation, you can be confident that you entered the correct email address.

The use of personal information is governed by applicable data protection legislation and Klarna's privacy policy.

In order to offer Klarna's payment methods, we are required to share certain information about you with Klarna as a third party. Klarna uses this information to assess whether you qualify for their payment methods.

The information used includes your name, address, email address, telephone number, payment history, and order information such as payment method, shipping method, order details and similar information.

The use of this information is governed by applicable data protection legislation and Klarna's Privacy Policy.

The buyer is responsible for ensuring that the information provided is correct, including information entered through automatic form filling.

If the buyer (you) is under 18 years of age, payment by invoice cannot be used. This is because a minor would incur debt through subsequent payment, which is prohibited under Section 9, cf. Section 40 of the Norwegian Guardianship Act [5].

We also recommend that minors speak to an adult before making a purchase from the online store.

6. Shipping and Delivery

The normal delivery time is 7–10 business days. Longer delivery times or delays may occur during periods of high demand.

The applicable delivery time for the available shipping methods will be shown at checkout before the order is placed.

As a general rule, we do not deliver to Svalbard, Jan Mayen or outside Norway. If you would like delivery to one of these locations, please contact us at moscreateda@gmail.com.

The shipping cost is NOK 89 for all orders, regardless of size or weight.

Orders are delivered by an external carrier, Posten, using Norgespakken. Deliveries are carried out in accordance with Posten's terms and conditions.

By completing your order and accepting our terms and conditions at checkout, you agree to the chosen delivery method.

If you have changed your address and/or have temporary mail forwarding, you are responsible for ensuring that your customer information, including delivery details, is updated when placing an order with us.

This also applies to Klarna's automatic form filling at checkout.

Tracking

Tracking is provided through Norgespakken's delivery service.

Orders with home delivery that cannot be delivered due to missing information or lack of communication from the customer regarding the delivery time will be charged a fee of NOK 150 to cover the cost of returning the shipment to the seller.

Orders with home delivery that are automatically returned to us will normally not be covered by the right of withdrawal.

Any refund will be made using the same payment method used for the original purchase.

7. Risk in the Goods

The risk associated with the goods passes to the buyer when the buyer has received the goods in accordance with Section 6.

If the consumer has asked a third party to receive or collect the goods on their behalf, this remains the buyer's responsibility.

If the delivery time has arrived and the buyer fails to take possession of goods that have been made available to the buyer in accordance with the agreement, the buyer nevertheless bears the risk of loss or damage caused by the inherent characteristics of the goods themselves.

If the goods are lost or damaged before physical possession has been transferred, the seller bears the risk.

If the goods are lost or damaged after physical possession has been transferred, the buyer bears the risk.

If the consumer chooses their own carrier to perform the transportation and this carrier was not offered by the seller, the risk passes to the consumer when their chosen carrier takes possession of the goods.

8. Right of Withdrawal

Right of Withdrawal

The buyer has a statutory right to withdraw from the purchase within 14 days without giving a reason.

The withdrawal period runs for 14 days from the date you received the goods.

It is the buyer's responsibility to document the withdrawal.

If you exercise your right of withdrawal, you will be refunded the purchase amount. Any return shipping costs may be deducted.

If the buyer wishes to exercise the right of withdrawal, the goods must be returned no later than 14 days after notice of withdrawal has been given.

As the buyer, you are responsible for the cost of returning the goods unless otherwise agreed directly with the seller.

The buyer is permitted to carefully examine the goods in order to assess their condition before deciding whether to exercise the right of withdrawal.

When exercising the right of withdrawal, the goods must have all labels intact and be in the same condition as when received.

If examination of the goods goes beyond what is reasonable and necessary, the buyer may be held responsible for any reduction in the value of the goods.

If you exercise your right of withdrawal, HuntVard, operated by MOS Create DA, represented by Henning Moen, Magnus Smith and Lotta-Linn Vestli Moen, is required to refund the purchase price once the returned goods have been received and approved as a return.

This refund will be made no later than 14 days after we have received notice that you wish to exercise your right of withdrawal.

If you wish to exercise your right of withdrawal, please send us a notice together with proof of purchase and a completed withdrawal form by email to moscreateda@gmail.com.

Exchanges and Returns

You have a 30-day open purchase period provided that the goods have only been inspected, all labels remain intact, and the goods are in the same condition as when you received them, in order to preserve their value.

If examination of the goods goes beyond what is reasonable and necessary, the buyer may be held responsible for any reduction in the value of the goods.

Exceptions to the Right of Withdrawal under Section 22 of the Right of Withdrawal Act

If you order a product that has been personalised or has a distinct personal character, it is exempt from the right of withdrawal.

The buyer will be informed of this before the agreement is concluded.

9. Delayed or Missing Delivery – Buyer's Rights and Time Limit for Claims

If the seller fails to deliver the goods or delivers them later than agreed, and this is not due to the buyer or circumstances on the buyer's side, the buyer may, pursuant to Chapter 5 of the Norwegian Consumer Purchases Act and Sections 22–29 of the Norwegian Sale of Goods Act, as applicable, withhold payment, demand fulfilment, terminate the agreement and/or claim compensation from the seller.

HuntVard, operated by MOS Create DA and represented by Henning Moen, Magnus Smith and Lotta-Linn Vestli Moen, is not responsible for delays beyond our control, such as delivery delays caused by unusually high volumes in the postal system.

If the buyer has unsuccessfully attempted to resolve the matter with the seller and the goods were paid for by credit card, the buyer may choose to make a claim directly against the credit provider. [10]

10. Defects in the Goods – Buyer's Rights and Complaints Period

The buyer's rights in the event of defects are regulated by Chapter 6 of the Norwegian Consumer Purchases Act.

The specific limits regarding which remedies may be claimed in each individual case will depend on an assessment of the circumstances.

If the goods are defective or damaged upon receipt, the buyer must contact the seller as soon as possible to report the issue.

The statutory complaints period is 2 years. Normal wear and tear is not covered by the right to make a complaint.

If the buyer believes that wear and tear exceeds what would normally be expected, the buyer is asked to provide photographic documentation as part of any complaint.

If the buyer wishes to return goods due to a complaint, please contact us at moscreateda@gmail.com and provide photographs of the goods and the defect.

If a complaint is approved by our online store, your money will be refunded to the account or payment method used for the original payment.

This will take place within 2–7 business days after we have received, registered and approved your return.

For purchases made by invoice, Klarna, our invoice provider, will contact you regarding the refund of your approved complaint.

You will receive an email when we have received your return. This may take up to 20 business days.

In the event of an approved complaint, return shipping costs will not be deducted from your refund.

The buyer may choose to have the defect corrected or to receive a replacement product.

If the buyer chooses a replacement product, please note that the products are handmade. Minor differences between the originally delivered product and the replacement product may therefore occur.

If the goods have been damaged during transport, the buyer is asked to notify us as soon as possible and provide photographic documentation to moscreateda@gmail.com.

We cannot guarantee that the colours displayed on your device correspond exactly to the actual colours of the products, as this depends on the settings of your device.

If the buyer has unsuccessfully attempted to resolve the matter with the seller and the goods were paid for by credit card, the buyer may choose to make a claim directly against the credit provider.

11. Seller's Rights in the Event of Buyer's Breach of Contract

In addition to the provisions of Section 11 of these terms and conditions, the seller's rights in the event of the buyer's breach of contract are regulated by Chapter 9 of the Norwegian Consumer Purchases Act.

The specific limits regarding which remedies may be claimed in each individual case will depend on an assessment of the circumstances.

Reference is also made to the practice of the Norwegian Consumer Complaints Board regarding which factors may be relevant to each remedy and the applicable threshold.

If the buyer fails to pay or otherwise fulfil their obligations under the agreement, and this is not due to the seller or circumstances on the seller's side, the seller may, pursuant to Chapter 9 of the Norwegian Consumer Purchases Act and depending on the circumstances, withhold the goods, demand fulfilment of the agreement, terminate the agreement and claim compensation from the buyer.

The seller may also, where applicable, claim interest for late payment, collection fees and fees for goods that have not been prepaid and are not collected.

Furthermore, we reserve the right to cancel orders intended for resale.

This may be suspected in cases involving large quantities or multiple orders of the same product.

If you are interested in cooperation or in stocking our products for resale, buyers, retailers or potential business partners are asked to contact us at moscreateda@gmail.com rather than purchasing large quantities through the online store.

If the buyer fails to pay the purchase price in accordance with the agreement, the seller may charge interest on the outstanding amount pursuant to the Norwegian Interest on Overdue Payments Act.

In the event of non-payment, the claim may, following prior notice, be referred for debt collection, and the buyer may then be held responsible for applicable collection fees under the Norwegian Debt Collection Act.

If the buyer fails to collect or accept ordered goods, the buyer may be charged a fee of NOK 100.

The fee may not exceed the seller's actual costs for transporting the goods.

Such a fee cannot be charged to buyers under 18 years of age.

12. Warranty

The seller guarantees that the goods delivered to the buyer are complete and correspond to the description provided on the product information page.

This is in addition to the statutory rights the buyer has under mandatory legislation.

A warranty therefore does not limit the buyer's right to make complaints or claims relating to delays or defects under Sections 9 and 10.

All products sold can legally be used in Norway.

13. Personal Data

By registering your order, you agree that your personal data may be stored and used to complete and deliver your order and to provide you with the service and shopping experience you expect.

By providing your personal data, you agree that your information may be used to provide the services you use.

Where there is an existing customer relationship, marketing may only concern the seller's own goods, services or other offerings similar to those covered by the existing customer relationship.

The service providers we use require access to certain personal data in order to provide their services, such as payment through Klarna and delivery through Posten.

All personal data processed by the seller is stored within the EU/EEA.

Henning Moen of MOS Create DA is responsible for ensuring that the processing of personal data is carried out in accordance with applicable law, together with our service providers and partners (Posten, Klarna, Webnode and Google).

The Norwegian Data Protection Authority (Datatilsynet) supervises compliance with data protection regulations in Norway.

You have the right to lodge a complaint with the Norwegian Data Protection Authority regarding the processing carried out by the data controller in connection with this privacy policy.

If there are changes to the processing of personal data, services or applicable privacy legislation, this privacy policy will be updated to reflect the actual processing of personal data.

You will be informed of such changes through the contact information registered for you.

Personal data relating to buyers under the age of 15 may not be collected unless the seller has obtained consent from a parent or guardian.

14. Dispute Resolution

Complaints must be submitted to the seller within a reasonable period of time, cf. Sections 9 and 10.

The parties shall attempt to resolve any disputes amicably.

If this is unsuccessful, the buyer may contact the Norwegian Consumer Authority (Forbrukertilsynet) for mediation.

The Norwegian Consumer Authority can be contacted by telephone at +47 23 400 600 or through Forbrukertilsynet.no.

The European Commission's complaints procedure may also be used if you wish to file a complaint. This is particularly relevant if you are a consumer residing in another EU country.
